Terms of Service
1. Scope and Agreement
These Terms of Service constitute a legally binding agreement between you ("User" or "Customer") and Aproxia ("Aproxia", "we", or "Provider") governing your use of the Aproxia remote desktop client software and associated network infrastructure.
By downloading, running, installing, or accessing Aproxia, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
2. Software License Grant
Aproxia grants you a limited, non-exclusive, non-transferable, revocable license to use the software under the following terms:
- Personal / Evaluation Use: Complimentary and testing versions are provided for non-commercial evaluation and personal remote troubleshooting.
- Commercial & Team Use: Providing paid IT advisory services, enterprise helpdesk, or managed remote support requires an active Professional or Enterprise subscription.
- License Restrictions: You agree not to decompile, reverse engineer, disassemble, modify, or create derivative works of Aproxia proprietary binaries.
3. Connection Security and Session Sovereignty
Aproxia enforces strict host-controlled security protocols:
- Unique ID and One-Time Passwords (OTP): Connection sessions rely on dynamically generated IDs and cryptographically random session passwords.
- Active Authorization: Remote sessions cannot be established without explicit credential sharing by the host operator, or prior manual configuration of unattended access.
- Instant Session Termination: The local host user retains perpetual authority to sever remote desktop sessions instantly via the toolbar controls.
4. Pricing, Invoicing, and Commercial Terms
Commercial subscription tiers, seat licensing, and billing periods are outlined in our Pricing section. Transactions are invoiced in supported currencies (USD, EUR, RON). For United States and international corporate accounts, Aproxia provides full commercial governance, including W-8BEN-E tax forms and direct USD ($) invoicing.
5. Service Availability and SLA
Aproxia strives to maintain 99.9% operational availability across its rendezvous and encrypted relay cluster, verifiable at our public system status page. We do not warrant uninterrupted connectivity caused by local ISP failure or corporate firewall restrictions.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Aproxia is provided on an "AS IS" and "AS AVAILABLE" basis. In no event shall Aproxia or its officers be liable for indirect, incidental, punitive, or consequential damages (including loss of data, revenue, or business interruption) arising from use or inability to use the software.
7. Anti-Fraud & Zero-Tolerance Abuse Policy
Utilizing Aproxia for fraudulent impersonation, tech support scams, phishing, or malicious intrusion is strictly prohibited. Offending network endpoints and IDs are subject to immediate permanent blacklist and criminal referral.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the European Union, with dispute resolution conducted under competent European courts, without prejudice to mandatory statutory consumer protections.
